Non-Domicile Citizenship Requirements for Licensing
On May 11, 2026, the U.S. Department of Transportation (USDOT) announced a final rule to strengthen federal oversight of how states issue non-domiciled commercial learner's permits (CLPs) and commercial driver's licenses (CDLs).
Effective, Wednesday, May 13, 2026, the issuance of non-domiciled CDLs and CLPs, also known as non-immigrant or Temporary CDLs or CLPs, will be modified to require all non-citizen applicants (except for lawful permanent residents) to provide an unexpired foreign passport and an unexpired Form I-94/94A (Arrival/Departure Record) indicating one of the specified employment-based non-immigrant categories at every issuance, transfer, renewal, and upgrade action defined in the regulation:
- H-2A (Temporary Agricultural Workers)
- H-2B (Temporary Non-Agricultural Workers)
- E-2 (Treaty Investors)
This change eliminates eligibility for asylum seekers, refugees, DACA recipients, and others who previously qualified with Employment Authorization Documents.
Applicants that present legal presence documentation from Canada or Mexico are not eligible to be issued a non-domiciled CLP or CDL.
Applicants that have been issued a non-domiciled CLP, also known as non-immigrant or Temporary CLP under the previous policy that do not meet the updated requirements are no longer eligible to be issued a CLP or CDL. These applicants will not be issued a CDL even if they have previously completed their required training and have passed the three-part CDL Skills Test prior to the final order from USDOT being issued.
At this time, only non-domiciled (non-immigrant) customers who meet the NEW lawful presence requirements can be allowed to take the skills exams.
Non-Domicile Definitions
A Commercial Learner's Permit (CLP) is a permit that allows a person to begin the process of learning how to operate a commercial motor vehicle while under the direct tutelage of a person who holds a valid Commercial Driver’s License (CDL).
A CLP is considered non-domiciled when the holder of the CLP is not a permanent resident of the state and has their permanent home is outside the United States. The purpose of the non-domiciled CLP is to allow foreign nationals who are legally residing in the United States to begin the process of obtaining a CDL to work in the trucking industry.
